These terms are the agreement between you and e-Lojiks Technology, the Papua New Guinean company behind NiuginiHR. They explain what you can expect from us and what we ask of you in return. We've kept the language plain on purpose — if anything here is unclear, please just ask us before you sign up.
1Who we are
NiuginiHR is an online HR and payroll platform designed and built in Port Moresby by e-Lojiks Technology. When we say "we", "us" or "NiuginiHR", we mean e-Lojiks Technology. When we say "you" or "your organisation", we mean the business that registers for an account and the people it authorises to use the system.
Every organisation gets its own workspace on its own subdomain — for example, yourcompany.niuginihr.com — with its own database that is kept separate from every other organisation on the platform.
2Agreeing to these terms
By registering an organisation, creating an account, or using NiuginiHR in any way, you're agreeing to these terms on behalf of your organisation. If you're the person setting up the account, you're confirming that you're allowed to enter into this agreement for your business.
If you don't agree with something here, that's completely fine — but please don't create an account until it's sorted out. We're happy to talk it through.
3Your account and subdomain
When you register, you choose a subdomain and create the first administrator account. That administrator can then invite the rest of your team and decide what each person is allowed to see and do.
- Keep your login details private. You're responsible for what happens under your accounts.
- Use real, accurate details when you register — especially your organisation name, IRC/TIN and contact information.
- Tell us straight away at support@niuginihr.com if you think someone has got into your account without permission.
- Your subdomain stays with your account. It isn't a domain name you own separately, and we may reclaim obvious misuse or reserved names.
4The free trial
New organisations start on a free trial. You don't need a card, and we don't take any payment to begin. The trial runs for the number of days shown on your plan, and we'll remind you by email before it ends.
When the trial finishes you can move onto a paid plan to keep going. If you decide NiuginiHR isn't for you, you simply don't continue — there's nothing to cancel and nothing to pay.
5Plans, pricing and payment
Our plans and prices are shown during signup when you choose a plan. We bill in Papua New Guinea Kina (PGK). Prices are exclusive of GST unless we say otherwise, and any GST that applies will be added to your invoice.
- You can pay monthly or yearly. Yearly works out cheaper, and you can switch when your term renews.
- For now we invoice you and you pay by bank transfer — Kina Bank, BSP and other local banks are all fine. We'll add card and online payment options later.
- Your subscription renews automatically for the same period unless you tell us you'd like to stop before the renewal date.
- Fees already paid aren't generally refunded for part of a period, but if something has clearly gone wrong on our side, talk to us and we'll make it right.
If an invoice isn't paid by its due date, we'll follow up. We may place the account into a payment-due state, and if it stays unpaid we may suspend access until it's settled. We'll always give you fair notice before that happens.
6How you may use NiuginiHR
NiuginiHR is here to help you run your HR and payroll properly. We ask that you use it lawfully and sensibly. In particular, please don't:
- Use it to break the law, or to store or process information you have no right to hold.
- Try to reach another organisation's data, or get around the separation between workspaces.
- Upload viruses or malicious files, or attempt to attack, overload or interfere with the platform.
- Resell, rent out or repackage the service as your own without a written agreement with us.
- Copy, reverse-engineer or take apart the software itself.
The NiuginiHR software, its design, and the e-Lojiks Technology name and logo belong to us. You're welcome to use the service under these terms, but that doesn't transfer ownership of the software to you.
7Your data stays yours
The information your organisation puts into NiuginiHR — your employee records, timesheets, leave, payroll and documents — belongs to you, not to us. We store and process it so we can run the service for you, and for no other purpose.
We don't sell your data, and we don't hand it to anyone else except where we genuinely need to in order to run the service (for example, the hosting company that keeps the servers running) or where the law requires it. How we handle personal information is set out in full in our Privacy Policy.
You can ask us for an export of your organisation's data while your account is active, and for a reasonable period after it closes. We hold onto a closed account's database for a set retention window before permanently deleting it, so a genuine mistake doesn't cost you everything — see the Privacy Policy for the details.
8Payroll, tax and superannuation
This one matters, so please read it carefully. NiuginiHR does the heavy lifting of payroll for you — fortnightly cycles, salary and wages tax using IRC tax tables, NASFUND and Nambawan Super, dependant rebates, salary sacrifice and bank payment files. We keep the tax tables and super rates as up to date and accurate as we reasonably can.
But NiuginiHR is a tool, not your accountant, bookkeeper or registered tax agent. You remain responsible for what you actually pay your staff and what you remit to the Internal Revenue Commission, NASFUND, Nambawan Super and any other body. That means you should:
- Enter correct salaries, hours, entitlements and employee details.
- Check each payroll run before you approve it and before you pay anyone.
- Lodge and pay your SWT, superannuation and other obligations on time.
- Get advice from a qualified accountant or tax agent for anything unusual about your business.
We'll always fix a genuine error in our calculations as quickly as we can, but we can't be responsible for penalties, interest or shortfalls that come from incorrect information being entered, runs not being checked, or obligations not being lodged on time.
9Availability and support
We work hard to keep NiuginiHR up and running around the clock, and to keep your data safe. From time to time we may need to take the service down briefly for maintenance or updates, and we'll try to do that at quiet hours and let you know in advance where we can.
Support is included with every plan. Our team is based in Port Moresby and available seven days a week, in your time zone and in plain language. You can reach us by email or WhatsApp using the details at the bottom of this page, and we provide free training to help your team get started.
10Suspension and ending your account
You can stop using NiuginiHR at any time — just let us know and we'll close the account at the end of your paid period. We may suspend or close an account if fees stay unpaid after fair notice, if these terms are seriously or repeatedly broken, or if we're required to by law.
When an account closes we don't delete your database straight away. We keep it, isolated and inaccessible to others, for a defined retention period so you have a window to return or ask for an export, after which it's permanently deleted. The retention period is set out in our Privacy Policy.
11Our liability
We take real care with NiuginiHR, but no software is perfect and we can't promise it will never have a fault or be unavailable. To the extent the law allows, NiuginiHR is provided on an "as is" basis and we don't give guarantees beyond those written into these terms.
Nothing here removes any rights you have under Papua New Guinean law that can't be excluded. Subject to that, we won't be liable for indirect or consequential losses, lost profits, or loss of data caused by things outside our reasonable control. Where we are found liable, our total responsibility to you is limited to the fees you paid us for the service in the twelve months before the issue arose.
12Changes to the service and these terms
NiuginiHR keeps improving. We add features, adjust tax tables and super rates as they change, and occasionally retire things that are no longer useful. We may also update these terms from time to time.
When we make a meaningful change to these terms, we'll update the date at the top of this page and, where the change is significant, let you know by email or inside the app. If you keep using NiuginiHR after a change takes effect, that means you're okay with the updated terms.
13Governing law
This agreement is governed by the laws of the Independent State of Papua New Guinea. If a dispute ever comes up, we'd always rather sort it out with a conversation first — so please contact us and give us the chance to fix it. Anything that can't be resolved that way will be dealt with by the courts of Papua New Guinea.
